Welcome to ComeAway! These Terms of Service (“Terms”) govern your use of our website, the ComeAway Sleep app, and our products and services. By accessing or using our services, you agree to these Terms.

1. Who We Are

ComeAway Inc. and ComeAway Wellness Co. (“ComeAway,” “we,” “our,” or “us”) designs and sells sleep products and offers the ComeAway Sleep app.

2. Eligibility

You must be at least 13 years old to use our services in the United States, and at least 16 years old in Canada or other regions where higher age limits apply.

3. Purchases & Orders

  • When you place an order, you agree to provide accurate and complete information.
  • Prices are shown in USD or CAD (as indicated). Taxes and shipping costs may apply.
  • Payment is processed securely through third-party providers (Shopify, Stripe). We do not store full payment card information.
  • We reserve the right to refuse or cancel orders if fraud or unauthorized activity is suspected.

4. Shipping & Delivery

  • We currently ship to the United States and Canada.
  • International shipping may be available — contact us for details.
  • Delivery times are estimates and may vary based on location and carrier.
  • Risk of loss passes to you upon delivery to the shipping carrier.

6. App Access & Subscriptions

  • The ComeAway Sleep app is free to download.
  • Full access may be provided to verified mask purchasers or through subscription.

Subscription Terms

  • Subscriptions are billed on a recurring basis (monthly or annually, as selected).
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • You may cancel your subscription at any time through the app settings or our website.
  • Refunds for subscription fees follow our standard refund policy.
  • If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless cancelled in advance.

You are responsible for keeping your account login details secure. We may suspend or terminate access if you misuse the app or violate these Terms.

7. Intellectual Property

All content, including the app, mask designs, text, images, and audio tracks, are owned by ComeAway or licensed to us. You may not copy, distribute, or resell our content without permission.

8. Disclaimer of Warranties

Our products and services are provided “as is” and “as available.”

  • Our sleep products are intended for general wellness and relaxation purposes only.
  • They are not medical devices and should not be used to diagnose, treat, or cure any medical condition.
  • Consult a healthcare professional if you have sleep disorders or medical concerns.

9. Limitation of Liability

To the fullest extent permitted by law:

  • ComeAway is not liable for indirect, incidental, or consequential damages.
  • Our total liability for any claim is limited to the amount you paid us for the product or service in question.

10. User Content & Feedback

If you share feedback, reviews, or suggestions, you grant us a non-exclusive license to use that content for business purposes.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

12. Regional Rights

  • US Residents (California, Colorado, etc.) → You may have additional rights under state privacy laws; see our Privacy Choices page.
  • Canadian Residents → You have rights under PIPEDA to access and correct your personal information.

13. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, strikes, shipping disruptions, or internet outages.

14. Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining sections remain in effect.

15. Dispute Resolution

If you have an issue with our products or services, please contact us first at support@comeaway.com. We will attempt to resolve disputes in good faith before resorting to legal action.

16. Governing Law

These Terms are governed by the laws of Alberta, Canada. Disputes will be resolved in Alberta courts, except where consumer protection laws in your jurisdiction provide additional rights that cannot be waived.

17. Changes to Terms

We may update these Terms from time to time. Updates will be posted with a new “Effective Date.” Continued use of our services means you accept the changes.
